AUDIT SUMMARY: THE BUILDING IS IN A RELATIVELY BAD CONDITION AND NEEDS RENOVATION URGENTLY. THE EXTRAORDINARY AUDIT DOCUMENT CONTAINS 10 PAGES IN WHICH, ON THE BASIS OF THE CONSTRUCTION TECHNICAL INSPECTION, A LIST OF DEFICIENCIES, 27 EMERGENCY WORKS AND 18 RECONSTRUCTION PROPOSALS WAS COMPILED.
The apartment association (board) has caused a decrease in the value of the property, because it has not ensured the preservation of the property (the condition of the building deteriorates over time), the necessary works have not been ordered or they have been ordered and carried out in a non-compliant manner, they have not used them (see RKTKo no. *-*-*-*** -** d 23, https://www.riigikohus.ee/et/lahendit/?asjaNr=3-2-1-116-11) and did not publish the original documents on how the money was used. At the same time, a member of the management board who is a real estate entrepreneur and his accountant husband are related to a construction entrepreneur who has been criminally found guilty of giving a bribe (bribery) and committing agreements and concerted activities that harm competition in the procurement of construction and repair works, construction and repair works of PERH, Tabasalu Ühisgymnaasium and MTÜ Harjumaa Construction and repair work tenders organized by the Public Transport Center (see HMKo criminal case no. *-**-****, https://www.riigiteataja.ee/kohtulahendit/fail.html?fid=237295419). The apartment association has conflicts both between the members and the board, as well as within the board.
The circumstances in which the buyer of the apartment property has a recognizable significant interest within the meaning of the first sentence of § 14 subsection 2 of the VÕS are hereby published, while the fact that the apartment property is properly managed is also considered as a normal property of the apartment property being sold within the meaning of § 217 subsection 2 p 2 of the VÕS (see e.g. RKTKo no. *-* -*-**-** p 17, https://rikos.rik.ee/?asjaNr=3-2-1-43-15).
